Gaps for the Implementation of the Framework Convention on Tobacco Control in Cuba

Introduction: The World Health Organization Framework Convention on Tobacco Control is a legal instrument under international law, binding on countries that sign and ratify it. Cuba signed but has not ratified it; however, it has had a framework for national action since 1987 through the Program for the Prevention and Control of Smoking.
Objectives: to determine compliance with Articles 11 and 13 of the Framework Convention on Tobacco Control; to characterize gaps with what is established in the studied articles.
Methods: descriptive study, using bibliographic and documentary review, questionnaires, and consultation with experts, with designed and validated instruments. Interactive workshop with experts, brainstorming to create a list of gaps using the 70 % rule.
Results: the provisions established in Article 11 of the FCTC are met, although with warnings and without images; there are gaps, such as the need to approve a new resolution to replace the current one, which includes the specified sections. The requirements of Article 13 are not fulfilled, with gaps including insufficient control; the absence of a requirement that all advertising, promotion, and sponsorship be accompanied by a warning or health message; and the absence of restrictions on the use of direct or indirect incentives that encourage tobacco product purchases by the population.
Conclusions: Cuba meets the established provisions of Article 11 of the FCTC/WHO, with the remaining gaps related to advancing towards the higher targets set in this convention. Cuba has gaps in its legislation that do not comply with the provisions established in Article 13 of the FCTC/WHO and require a legal framework to support them.
